Task

Find atleast two (deposited sources) argument as to why the currently copyright laws of the "digital society" is no longer applicable. Take position to argue.

 

What is copyright Law in our Digital Society?

Copyright protection exist from the moment a work is created in a fixed, tangible form of expression. The copyright immediately become the property of the author who created the work. Only the author, or those deriving their rights through the author, can rightfully claim copyright.

Copyright regulation is facing serious challenges in the society according to „Stefan Larson“. This issue is one oft he most famous problem in our Digital Society.

Arguement 1. Copyright is of such Vital Interest

          The last fifty years, copyright has expanded it’s protection and that this has been done „almost entirely in the absence of empirical evidence, and without empirical reconsideration to see if our policies were working“. And this „evidence – free development runs on „faith alone“ and it is the faith that is based on a cluster of ideas “. (Boyle 2008, p.236)

Own Opinion

          As the copyright protection expand it‘s policies before and now, it is true as we people observe that the empirical evidence is not quite working in our social digital law anymore, and as of that the copyright is expanding to it’s broad issue of vital interest.

 

Arguement 2. Fair access to the digital material for educational and other sociality necessary purpose.

          The public domain is a common property of the public, made up of all these works that are not, or are no longer subject to proprietary rights, such as copyright, and are therefore freely available to all users. The utilization of such resources cannot in theory be restricted, and there are no royalties to be paid to any right holders.

 Own Opinion:

               The fairness of the copyright law policies in educational needs and development are getting fair for all users now a days. Public domain is good opportunity for the users especially for the people who can not afford to buy it.

          In the other hand, these public domain affects the creator or the maker of the product, but according to the policies of copy right now a days there are such thing as „each new creator should be able to build on the works of those who came before“.
